Code of Conduct

The Code of Conduct applies to all residents, renters and visitors to Altos de la Marquesa VII. The Community of Owners welcomes everyone to the Urbanisation but we ask you to please read this, as it does apply to you.

Community of Owners

When you buy a private property in Spain you often buy some common elements in the apartment block or the urbanisation where your property is situated. You become a member of a “Communidad de Propietarios”, a Community of Owners.

We are all subject to Spanish Law and the Spanish system of government is probably quite different to that of your home country so it is worthwhile getting to know at least some of the basics. In order of precedence there are national laws, regional laws, provincial laws and municipal laws. In addition, the Community of Owners can agree a set of Internal Rules which only apply within the Urbanisation boundaries. Community Internal Rules may amplify the law, but can never contradict it.

All Communities are governed by the Law of Horizontal Property or “La Ley de Propiedad Horizontal” which is the Spanish system for regulating the joint ownership of common property. This law defines the rights and responsibilities of the Owners, President and Administrator. The law states that Community of Owners is there to administer the parts of the Urbanisation that we jointly own (i.e. swimming pool, roads, drains, street lights etc.) and can have no other purpose.

Health and Safety Rules are governed by Spanish Law and must be observed or the Community can be heavily fined.

Respect for Other People

Our Code of Conduct contains a set of Internal Rules based on common courtesy and respect for other people and is meant as a guide to everyday life within Altos de la Marquesa VII. It is there to enhance our lives and to make Marquesa VII a pleasant, safe and attractive place for us all to enjoy.

These rules are agreed and voted for at the Community Annual General Meeting, and apply to all residents, renters and visitors alike, this means EVERYONE. We do not discriminate on the grounds of age, colour, religion, nationality, gender, or anything else for that matter. If you disagree with any of the rules and do not want to comply then the Community of Owners asks you to please DO NOT come to Marquesa VII.

If you as an owner, renter or visitor are unsure about your rights within the Community then contact either the President or Administrator for clarification.

General

1. Noise

  1. It is the right of all residents to expect peace and quiet within reason. Excessive noise should be kept to a minimum during the day
  2. Building work should cease from 2.00pm - 4.00pm
  3. Sunday - All building work is discouraged, unless emergency repairs to household services are required
  4. Pet noise - Owners should stop their dogs from barking continuously
  5. After midnight keep general noise levels to a minimum

2. Wilful Damage

  1. Legal action will be taken against anyone wilfully vandalising Community property

3. General Maintenance

  1. All owners are expected to look after the general appearance of the Urbanisation
  2. All owners are obliged to maintain their properties and gardens in good condition

4. Vehicles

  1. Clear access must always be available for the Emergency Services. Vehicles are to be parked on one side of the street only
  2. Consideration for pedestrians and other drivers is to be exercised at all times
  3. The Speed Limit around the Urbanisation access roads is 25 kilometres per hour
  4. The sounding of a car horn to attract attention is discouraged

5. Building Alterations

  1. Property external walls and garden walls should conform to the original paint scheme (i.e. white walls with yellow contrast)
  2. External alterations to a property must be presented to the AGM for approval prior to any application to the Ayuntamiento and prior to the commencement of building work

6. Change of Ownership

  1. On selling your property, please advise the President of the new owner’s contact details
  2. New owners are asked to introduce themselves to the President at the earliest opportunity

7.Change of Address

  1. Owners are asked to advise any change in permanent address to the Administrator or President

8. Community Fees

  1. Owners are required by law to pay Community Fees, without exception
  2. The Community will take legal action against owners to recover outstanding fees

9. Visitors

  1. Owners are requested to inform the President of dates of occupation of family visitors and renters
  2. Owners must inform family visitors and renters of the Community’s Code of Conduct

10. Pets

  1. Communal areas are not to be used as a pets’ toilet. Owners of pets are required to remove any animal mess
  2. Owners are to ensure their pets are controlled at all times

Swimming Pool

11. Pool Closures

  1. Do not enter the swimming pool or surrounding areas when a pool closure notice is displayed on the entrance gate and/or notice board
  2. A notice will be displayed on the notice board if the pool is temporarily closed for maintenance reasons (i.e. safety, excessive chlorine treatment etc). The reason for closure and time of reopening will be displayed

12. No Smoking

  1. No smoking anywhere within the pool areas

13. Health and Hygiene

  1. Do not use the pool if you are ill
  2. No dogs or other pets are allowed within the pool or garden areas
  3. Shower each time before swimming
  4. Shampoos or soap are not to be used in the shower
  5. Babies must wear swim nappies
  6. Litter is to be taken away with you
  7. No food is to be taken into or eaten within the pool areas
  8. Drinks are allowed in plastic containers only
  9. Barbeques are not allowed in the pool or other Community areas


SWIM AND STAY HEALTHY

These rules apply to everyone, both adults and children alike. The risk of infection by bacteria and viruses is real. To minimise the risk the pool water is treated with chemicals and by observing the rules we can all swim and stay healthy.

You can help us to keep a high standard of pool water quality and reduce the likelihood of infections by following a few simple rules:-

14. Ball Games and Airbeds (Lilos)

  1. The playing of ball games and use of airbeds is permitted if the pool is not busy. It is your responsibility to exercise discretion and not to inconvenience other users of the pool

15. Visitors

  1. Marquesa VII Owners may invite external visitors to the pool
  2. Renters/Holidaymakers are not entitled to invite persons or families from other areas to Marquesa VII pool

16. Children

  1. Children under 12 must be supervised by an adult when in the pool areas
